I love the title and the intent of the article, I just wish you’d gotten the case law and legal cites accurate. What you describe as grey, I’d say is clearly Black and White.

I have almost a dozen OCR non-compliance reports for colleges and universities that makes it clear there’s no difference for accessibility in courses that sit behind a password. But if you’re only looking at Section 508 — and your interpretation is shaky, Mixing it with ADA complicates things, and you miss Section 504 which applies to academic institutions and is the key legislation relative to accessibility in online learning.

Look at the publication I wrote for iNACOL and the legal citations. (http://tinyuurl.com/equityandaccessforall) And while that was written for the iNACOL membership (which is predominantly K-12) I state that the legal findings/case law reflect the same interpretation for all online courses.

It’s a nice article but you’re not completely correct. You say: ” course materials are usually restricted to just the students taking the classes. So far, there have not been any cases challenging this.” But I have copies of compliance reviews conducted by OCR for universities, community colleges, and K-12 schools where they are all cited for not making online materials in online courses accessible. You focus on Section 508 when you should be referencing Section 504 for academic institutions. You might find the publication I did for iNACOL to be useful in updating your understanding.
